These terms are the agreement between you and ZMIZE PTY LTD ("we", "us") for font.zmize at https://font.zmize.com (the "Service"). They are deliberately short. Read them — by using the Service you agree to them.
Our Privacy Policy is part of this agreement and explains what we do with your data.
You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live. If you are under 18, you may only use the Service with a parent or guardian's permission.
If you are using the Service on behalf of an organisation, you are agreeing to these terms for that organisation, and you confirm you are allowed to.
Most of the Service needs no account. Paid features are unlocked by signing in through auth.zmize; keep that sign-in secure and do not share it.
You are responsible for what happens under your account. Tell us at support@zmize.com as soon as you think someone else has access to it.
You agree not to:
We may suspend or terminate access that breaks this section. Where it is safe and lawful to do so, we will tell you why and give you a chance to fix it first.
"Your content" means any font file you upload and anything the Service produces from it. Deletion here is manual and on request: nothing in the Service expires or deletes content on its own, and we keep no scheduled backups — see *How long we keep it* in the Privacy Policy for exactly what that means in practice.
You keep ownership of everything you put into the Service. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display and process your content only to the extent needed to operate the Service for you — and for no other purpose. This licence ends when you delete the content or your account.
We do not use your content to train models for anyone else, and we do not use it to train any model.
The Service, its software, design and text are owned by ZMIZE PTY LTD or our licensors and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service while these terms are in force. You may not copy, reverse-engineer or create derivative works of the Service except to the extent the law expressly permits it.
The Service is built on open-source software, which stays under its own licence. Fonts the Service synthesizes are derived from open-source typefaces and are delivered with an attribution record naming every source face and its licence — that licence, not these terms, governs what you may do with the resulting font.
The Service links to and interoperates with other zmize services and with the third-party providers listed in the Privacy Policy. Your browser loads web fonts from Google Fonts and scripts from the jsDelivr CDN while the page is open.
We are not responsible for third-party services, and their terms — not ours — govern your use of them.
The Service is a proof of concept. We aim to keep it available but promise no uptime, and parts of it are explicitly experimental — they can change or disappear without notice and should not be relied on for anything important.
We may add, change or remove features. If we remove something you rely on, or discontinue the Service entirely, we will give you at least 30 days' notice and a way to export your data.
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular result.
The Service is a similarity tool, not a licensing authority. A font identification is a statistical judgement about shape and can be wrong. A licence label attached to a match is our best reading of that font's published terms, not legal advice and not a permission. Before using any font commercially — including one the Service synthesized for you — check its licence yourself, and take legal advice if the answer matters.
Some jurisdictions do not allow the exclusion of certain warranties. Nothing in these terms excludes or limits any right you have that cannot lawfully be excluded — including, in Australia, the consumer guarantees under the Australian Consumer Law.
To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused.
Our total liability for all claims arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) AUD $100.
These limits do not apply to liability that cannot lawfully be limited: death or personal injury caused by negligence, fraud, or wilful misconduct.
You agree to indemnify us against third-party claims arising from your breach of these terms, your misuse of the Service, or content you supplied — except to the extent the claim arises from our own breach or negligence. We will tell you promptly about any such claim and let you control the defence of it.
You can stop using the Service and delete your account at any time.
We can suspend or terminate your access if you materially breach these terms, if we are required to by law, or if continuing would create a security or legal risk. Except where immediate action is necessary, we will give you notice and a reasonable chance to fix the problem.
On termination: your right to use the Service ends, and we delete your data on the schedule in the Privacy Policy. Sections covering your content licence (to the extent already exercised), our IP, disclaimers, liability, indemnity and governing law survive.
These terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws rules. Disputes will be brought in the courts of New South Wales, Australia, and both of us submit to their jurisdiction.
Nothing here removes your right to bring a claim in the courts of your own country of residence where consumer law gives you that right, or to use any mandatory local dispute-resolution scheme.
Talk to us first. Before filing anything, email support@zmize.com with the problem. Most things are fixable in a day and we would rather fix it.
We may update these terms. We will post the new version here and move the "last updated" date. If a change is material — new obligations on you, reduced rights, new fees — we will give you at least 14 days notice before it takes effect. Continuing to use the Service after that means you accept the new terms; if you do not accept them, stop using the Service and, if you paid, ask us for a pro-rata refund of the unused period.
These terms, plus the Privacy Policy, are the entire agreement between us about the Service. If any part is unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor of our business.
